Terms and Conditions

1. Project Commencement

All projects will commence only after the agreed advance payment is received and the service agreement is signed by both parties. We reserve the right to delay the start date if these conditions are not met.

2. Domain & Hosting Management

At TenSketch, we handle end-to-end digital services. Unless explicitly agreed otherwise in writing, we manage the purchasing, configuration, and renewal of domains and hosting for projects we build. This ensures optimal performance, security, and integration.

If a client insists on managing their own hosting/domain, TenSketch is not responsible for server-side issues, downtime, or configuration errors.

3. Termination & Transfer

If a client wishes to terminate the agreement or transfer services away from TenSketch:

• All outstanding dues must be cleared in full.
• A transfer fee may apply for facilitating the migration of assets and data.
• TenSketch retains ownership of all code and design assets until final payment is made.

4. Content & Assets

Clients are responsible for providing all text, images, and brand assets required for the project in a timely manner. Delays in providing content will result in a corresponding delay in the project timeline.

5. Timeline & Delays

TenSketch will provide an estimated project timeline. However, we are not liable for delays caused by:

• Delayed client feedback or content submission.
• Changes in project scope (Scope Creep).
• Third-party service outages or force majeure events.

6. Revisions & Scope

The project agreement includes a specific number of revision rounds (typically two). Any additional changes or new features requested after approval will be billed separately as per our hourly rates.

7. Data Privacy & Security

TenSketch commits to protecting confidential client data. However, we are not liable for data breaches caused by client-managed passwords, compromised third-party integrations, or hosting accounts not managed by us.

8. Maintenance & Warranty

TenSketch provides a 30-day warranty period post-launch for fixing bugs related to our work. After this period, maintenance and updates are subject to a separate Annual Maintenance Contract (AMC).

9. Dispute Resolution

Any disputes arising from this agreement will be resolved amicably through negotiation. If unresolved, disputes shall be subject to the jurisdiction of the courts in Chennai, India.

10. Force Majeure

TenSketch will not be held liable for any failure to perform its obligations due to events beyond our reasonable control, including natural disasters, internet outages, or government restrictions.
